These Terms and Conditions (“Terms”) govern your access to and use of the websites, applications, software, and services (collectively, the “Services”) provided by Bettermind Labs LLC (“Bettermind Labs,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

 

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our Services. By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms.

 

2. Scope of Services

Bettermind Labs LLC develops and provides software applications, digital tools, and related services, which may be offered through our website and/or distributed via third-party platforms, including but not limited to the Apple App Store and Google Play Store.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, and without liability.

 

3. App Store Distribution

If you access or download our applications through a third-party platform or app store, including but not limited to the Apple App Store or Google Play Store, your use of the application is also subject to the applicable third-party platform’s terms, policies, and rules.

Bettermind Labs LLC is not responsible for the services, availability, pricing, payment processing, or policies of any third-party platform or app store.

In the event of any conflict between these Terms and the terms of a third-party platform, these Terms govern the relationship between you and Bettermind Labs LLC.
 

Apple Inc., Google LLC, and other app store providers are not parties to these Terms and have no responsibility for the Services. This agreement is between you and Bettermind Labs LLC, not Apple Inc. Apple has no responsibility for the Services or their content.

 

4. User Obligations and Acceptable Use

You agree not to:

  • Use the Services for any unlawful, harmful, fraudulent, or abusive purpose

  • Reverse engineer, decompile, disassemble, or attempt to extract source code

  • Interfere with or disrupt the security, integrity, or performance of the Services

  • Scrape, automate, or misuse the Services without authorization

You are responsible for ensuring that all information you provide is accurate, lawful, and up to date.

 

5. Intellectual Property

All software, content, trademarks, logos, designs, and materials made available through the Services are owned by or licensed to Bettermind Labs LLC and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for their intended purpose. No rights are granted except as expressly stated in these Terms.

 

6. User-Generated Content (If Applicable)

If the Services allow you to submit content:

  • You retain ownership of your content

  • You grant Bettermind Labs LLC a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display such content solely for operating, maintaining, and improving the Services

  • You represent that you have all necessary rights to submit such content

We reserve the right to remove content at our discretion.

 

7. Payments and Subscriptions (If Applicable)

Pricing, billing terms, and payment obligations will be disclosed prior to purchase. We reserve the right to change prices at any time. Taxes may apply depending on your jurisdiction.

Refunds, if any, are governed by the applicable app store’s refund policies or explicitly stated terms.

 

8. Third-Party Services and Links

The Services may contain links to or integrate with third-party services. We do not control and are not responsible for the content, services, or practices of third parties. Use of third-party services is at your own risk.

 

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERMIND LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

 

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERMIND LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Where liability limitations are restricted by law, liability is limited to the minimum extent permitted.

 

11. Indemnification

You agree to indemnify and hold harmless Bettermind Labs LLC from any claims, damages, losses, liabilities, or expenses arising out of your use of the Services or violation of these Terms.

 

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if the Services are discontinued.

You may stop using the Services at any time. Upon termination, all licenses granted to you under these Terms will immediately cease.

 

13. Privacy

Your use of the Services is governed by our Privacy Policy, which explains how we collect and process personal data in accordance with applicable data protection laws, including GDPR where applicable.

 

14. Changes to These Terms

We may update these Terms from time to time. Any changes become effective upon posting. Continued use of the Services after changes constitutes acceptance of the revised Terms.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States of America, without regard to conflict of law principles.

If you are located in the European Union, mandatory consumer protection laws of your country of residence remain unaffected.

Any disputes shall be subject to the jurisdiction of the courts where Bettermind Labs LLC is registered, unless otherwise required by applicable law.

 

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

17. Entire Agreement

These Terms constitute the entire agreement between you and Bettermind Labs LLC regarding the Services and supersede any prior agreements or understandings.
